Optibide is a website and mobile app (hereinafter referred to as “Website”) operated by Optibide Co.Ltd, a corporation headquartered at Room 215, Annex Building, Software Convergence Support Center, 4 Gyeonggang-ro 2326beon-gil, Gangneung-si, Gangwon-do, South Korea (hereinafter referred to as “We”, “Our”, or “Company”). We are an innovative startup that provides an AI-based hyper-personalized travel and accommodation reservation platform. The Optibide website helps users collect travel information and check the availability of customized travel products and services. Through the website, users can make reservations for various travel products such as hotels, airline tickets, transportation, and activities provided by third-party suppliers (hereinafter referred to as “suppliers”). When making a travel product reservation, the supplier’s terms and conditions (e.g., separate terms and conditions of the hotel or airline) apply separately from these Terms and Conditions, and an individual purchase contract is established between the user and the supplier. Please check the terms and conditions of each supplier. As a provider of mail-order brokerage services and additional services, our company is not a party to the purchase contract for travel products booked by users through the website, and responsibility for such products lies entirely with the supplier. In addition, these terms and conditions include website usage rules and also specify content standards for various interactions such as uploading content and linking within the website. By using our website and completing a reservation through us, the user agrees to these terms of use and will comply with them. I agree with that. We recommend that you read these Terms and Conditions (especially Section 10 Liabilities) carefully, and print and keep a copy for future reference. If you do not agree to these Terms and Conditions, you may not use our website and reservation services. You certify that you are legally competent to enter into binding contracts (e.g., meet the legal age in your country of residence) and that you will only use the Optibide website for lawful reservation purposes. If you are booking travel products on behalf of multiple people, the first registered user must (1) provide accurate information about the other users, (2) agree to and comply with these Terms and Conditions as their agent, and (3) You must check the details specified on the reservation confirmation page and notify us immediately if any errors are discovered, and (4) you are responsible for paying the full reservation fee and any additional costs. We may change these Terms and Conditions, and when we do, we will indicate the last update date at the top of the Terms and Conditions. Changed terms and conditions are effective immediately upon posting, so please be sure to check the latest terms and conditions each time you use our website or make a reservation. A ‘reference’ to this website is deemed to include linked websites, mobile apps and all derivative works, regardless of the type of mobile phone, tablet or other access device.

We are not responsible for websites linked to Optibide. Where the Optibide website contains links to other sites and materials provided by third parties, such links are provided for information purposes only and should not be construed as an endorsement by us of the linked websites or any information obtained from them. We have no control over the content or materials posted on such external websites.

The Optibide website may contain information and materials uploaded by other users, such as discussion rooms, bulletin boards, and reviews. We do not verify or approve the accuracy or suitability of such information and materials, and opinions posted on such websites do not represent our official positions or values. We expressly disclaim any liability to the extent permitted by applicable law for any loss or damage incurred in the Interactive Area due to a user's violation of the content standards set forth below. You may use the Optibide website only for lawful purposes. You may not use the Optibide website and services if you engage in any of the following acts, and this list is illustrative and not limiting.

These content standards apply to all materials (“Contributions”) you provide through your participation on the Optibide website.

You grant us the following permission: When you upload or post content to the Optibide Website, you grant us permission to use that content for the purpose of promoting the Website and Services. This right includes a perpetual, worldwide, non-exclusive, irrevocable, royalty-free, and transferable license to use, reproduce, distribute, modify, adapt, publish, translate, create derivative works of, and disclose in various media in connection with the Website and Services, with or without attribution, without prior notice. You also grant Optibide the right to take legal action against you for any infringement of your or our rights in the Content. You expressly waive, to the extent possible, any moral rights (including attribution rights and integrity rights) that may exist in the Content, and agree not to raise any objection with respect to the posting, use, modification, deletion, etc. of the Content. We clarify that we reserve the right to remove your Content at our sole discretion without notice. If you believe that any Content posted on the Website infringes your intellectual property rights, please immediately notify Optibide through the contact information set forth in Paragraph 1 of these Terms and Conditions.

You must not introduce software into the website. We do not guarantee that the Optibide website is completely secure or free from bugs and viruses unless we intentionally or grossly negligent. You are solely responsible for configuring the information technology, computer programs and platforms required to access the Optibide website, and you must use your own anti-virus software to stay safe. You will not knowingly install any viruses, Trojan horses, worms, logic bombs or other harmful or technologically hazardous material. You must not abuse the website. Additionally, you must not attempt to gain unauthorized access to the Optibide website or its connected servers, databases, or computer systems, and any attack, including DDoS (denial of service) attacks or distributed DDoS attacks, is prohibited.

You may link to our Optibide home page, provided you do so in a fair and legal manner and do not damage our reputation or take advantage of it. You must not establish a link that suggests any false association, approval or endorsement with respect to us. You must not establish a link to our Optibide site in a website that is not owned by you. You may not post our Optibide website as a separate area on any other site, or create a link to any part of our website other than the home page of our site. We provide prior notice to you. Link permission may be revoked without notice.

All details you provide when booking (including name, identification details, contact details, payment details and dates) must be accurate and complete. If you have accidentally provided us with incorrect information, please let us know and we will help you correct your reservation information. However, this is only possible if the supplier allows it, and we cannot 100% guarantee changes, especially if the change amounts to a change of identity (e.g. name, gender, etc.). We advertise a large number of travel products and whilst we strive to ensure that advertised prices are always accurate, errors may occasionally occur. If an error is apparent in our reasonable opinion, we may, in consultation with the Supplier, cancel the reservation in question or change the price (if the reservation holder agrees). Once your reservation request is complete, you will receive a reservation confirmation email from us. Please check the details provided in your reservation confirmation email and contact us immediately if there are any errors. For more information on confirming flight and hotel reservations, please see the related section below. You will be assigned an Optibide reservation number for each reservation. When contacting us regarding a reservation, please provide your Optibide reservation number to receive faster and more accurate assistance. The following actions are prohibited when using the reservation service:

When booking a travel product, payment terms are clearly displayed during the booking process. Some reservations require advance payment online, while others require payment at the time of travel (e.g. when checking into your accommodation). If full payment is not received in accordance with the booking conditions, we may cancel the booking immediately. Additionally, your reservation may be canceled if there are signs of fraud in your user pattern or reservation, or if your payment method fails for any reason. Exchange rates are reflected in real time, and when making an online prepayment, you must pay the exact amount displayed on the payment page. However, when paying in a different currency, the account issuing institution may apply a separate exchange rate, so please be sure to check this. In addition, overseas payment fees may be charged separately by the account issuing institution, and when paying on-site for travel products (e.g., hotel check-in), the exchange rate at the time of payment may be different from the time of reservation. If a problem occurs during the payment process, please do not forcefully retry. Please contact the contact information provided in Paragraph 1 of these Terms and Conditions to confirm whether the reservation was successfully completed. Refunds are generally processed using the original payment method, and the timing of refunds may vary depending on the account issuing institution. We collect your personal information and Payment information is protected as a top priority, and strong security measures are implemented to this end. This information reflects the reservation and payment policy of the Optibide platform.

Please make sure you have all necessary insurance and required travel documents for your trip. Such documents include, but are not limited to, passports, IDs, visas, hospital records (e.g., vaccination certificates). Although we offer travel products to specific destinations, Optibide does not recommend or guarantee that travel to or within those destinations is risk-free. Users must check travel warnings and restrictions for their destination before booking or traveling. Please note that it is your sole responsibility to obtain any necessary vaccinations and follow the advice of your physician while traveling.

If you register as an Optibide member, you will receive benefits for each membership level and Optiguard coin accumulation.

As a mail order broker, we only act as an intermediary for hotel reservations between customers and suppliers and are therefore not a party to the purchase contract for hotel products booked through our Optibide site. Your reservation is subject to the terms and conditions of the relevant supplier (i.e. the hotel you are staying in and its agents), which can usually be found on the hotel's official website. We can assist with smooth communication with suppliers, but we are not responsible for travel products or services provided or not provided by suppliers.

We will do our best to confirm your hotel reservation within the time period advised to you when making the reservation. Most of our rooms can be confirmed immediately, and you will be notified by email as soon as your reservation is confirmed. From then on, your room is guaranteed. If the user's reservation cannot be confirmed, refunds and other actions may be taken according to the hotel's terms and policies. Even after the hotel reservation is confirmed, there may be cases where the user contacts the hotel directly but the reservation is not confirmed, but you do not need to worry. Your reservation is still valid, but your personal information may not have been transferred to the hotel until closer to your reservation date. We will provide you with information regarding your rights to change and cancel your hotel reservation (including applicable costs) during the reservation process. Some rooms may not be able to be changed or refunded, so please be sure to check this before completing your reservation request. Even if changes are possible, there may be limitations on the hotels or rooms that can be changed depending on the circumstances of the hotel or third-party hotel provider, which may result in not being able to use all options or alternative rooms displayed on our Optibide website. If you request to change your hotel reservation, we will provide you with information on available options. If the hotel changes or cancels your reservation, the hotel's rules will take precedence, so please be sure to check the hotel's terms and conditions. Our reviews are based on user-approved reviews, and our hotel star ratings are determined by Optibide based on a comprehensive consideration of information provided directly by the hotel (e.g., hotel star ratings for the country or region in which the hotel is located), amenities, photos, reviews, and price.

As a mail order broker, we only act as an intermediary for activity reservations between customers and suppliers, and are therefore not a party to the purchase contract for activities you book through our Optibide site. As stated in the “Introduction to Terms and Conditions”, your reservation is subject to the terms and conditions of the relevant supplier (e.g. car rental company), which can generally be found on the official website of each supplier. Where possible, we provide a link to the applicable terms and conditions at the payment stage of the booking process.

Please be sure to check the relevant supplier's terms and conditions for information regarding your rights to change or cancel your booking. You may have been provided with some information about your rights when making a reservation. If the supplier changes or cancels your booking, their policies will generally apply, so please be sure to check their terms and conditions. We use your personal information in accordance with the provisions of our Privacy Policy (https://kr.trip.com/contents/service-guideline/privacy-policy.html?locale=ko-KR).

Most of the information posted on our Optibide website is provided by relevant suppliers or based on reviews written by travel product users. We make every effort to ensure the accuracy and completeness of this information to the extent permitted by law, but we cannot accept any liability for any loss or damage arising from inaccuracies or incompleteness of the information. Furthermore, we make no representations, warranties or conditions of any kind with respect to the information provided to users by the Optibide website, except where prohibited by law. To the maximum extent permitted by law, we will not be liable for any loss or damage arising from any of the following reasons:

We provide the Optibide website for personal, non-commercial use only, and are not liable for any loss of profits, business interruption, or loss of business opportunities resulting from business or commercial use. This limitation of liability is limited to the maximum extent prescribed by law, except as otherwise provided by relevant laws.

If an Optibide Platform user fails to comply with these Terms and Conditions or applicable laws and regulations, we may take any or all of the following measures without prior notice.

These Terms and Conditions and any disputes or proceedings arising therefrom (including non-contractual disputes or proceedings), and their subject matter and formation shall be governed by and construed in accordance with the laws of Singapore. You and we agree that the courts of Singapore will have exclusive jurisdiction over any dispute or proceeding (including non-contractual disputes and proceedings) relating to these Terms and Conditions, their subject matter or formation. However, this does not limit the user's legal right to file a dispute or lawsuit in court in the country where the user resides. These Terms and Conditions are a contract between you and us and no one else will have the right to enforce these Terms and Conditions. If a court or relevant authority finds any part of these Terms and Conditions to be in violation of the law, the remaining provisions will remain in full force and effect. Even if we delay in enforcing these Terms and Conditions, we may take action against you at any time in the future.
